XCut AI respects copyright. People who use XCut must own, or have permission to use, everything they upload, import or add to a canvas (see our Terms of Service). If you believe content on XCut infringes your copyright, tell us and we will act on it.
1. How to send a takedown notice
Email support@xcut.ai with the subject line “DMCA notice”, Your notice must include:
Your physical or electronic signature (typing your full name is fine)
The copyrighted work you say is infringed (or, for several works, a representative list)
Where the infringing material is on XCut: the link, or enough detail for us to find it
Your name, postal address, phone number and email address
A statement that you believe in good faith that the use is not authorised by the copyright owner, its agent or the law
A statement that the information in the notice is accurate and, under penalty of perjury, that you are the copyright owner or authorised to act for the owner
When we get a complete notice we remove or disable access to the material promptly and tell the person who added it. A notice that is knowingly false can make you liable for damages (17 U.S.C. § 512(f)).
2. Counter-notice
If your content was removed and you believe that was a mistake or misidentification, email support@xcut.ai with the subject line “DMCA counter-notice” and include:
Your physical or electronic signature
What was removed and where it was before it was removed
A statement under penalty of perjury that you believe in good faith the material was removed by mistake or misidentification
Your name, postal address and phone number, and a statement that you consent to the jurisdiction of the federal district court for your address (or, if you are outside the United States, any judicial district in which XCut may be found), and that you will accept service of process from the person who sent the original notice
We forward the counter-notice to the person who sent the original notice. Unless they tell us within 10 business days that they have filed a court action, we may restore the material 10 to 14 business days after we received the counter-notice.
3. Repeat infringers
We close the accounts of people who repeatedly infringe copyright. An account that receives valid notices for more than one separate infringement may be suspended or closed, and we may remove content at any time.
This page is not legal advice. If you are unsure whether material infringes your rights, talk to a lawyer before sending a notice.
